A PROCLAMATION BY GOVERNOR JOE LOMBARDO
TO CONVENE A SPECIAL SESSION OF THE NEVADA LEGISLATURE

WHEREAS, Section 9 of Article V of the Constitution of the State of Nevada provides that, "the Governor may, on extraordinary occasions, convene the Legislature by Proclamation and shall state to both houses, when organized, the business for which they have been specially convened"; and

WHEREAS, at a special session convened pursuant to Section 9 of Article V of the Constitution of the State of Nevada, "the Legislature shall not introduce, consider or pass any bills except those related to the business for which the Legislature has been specially convened and those necessary to provide for the expenses of the session"; and

WHEREAS, an extraordinary occasion now exists which requires immediate action by the Legislature.

NOW,THEREFORE, I, JOE LOMBARDO, GOVERNOR OF THE STATE OF NEVADA, by virtue of the authority vested in me by the Constitution of the State of Nevada, do hereby convene the Legislature into a Special Session to consider matters consistent with Senate Bill 194 (1st Reprint), Senate Bill 434 (3rd Reprint), Senate Bill 457 (2nd Reprint), Assembly Bill 238 (2nd Reprint), and Assembly Bill 404 (2nd Reprint) of the Eighty-Third Session of the Nevada Legislature, and Senate Bill 450 (1st Reprint) of the Eighty-Second Session of the Nevada Legislature; and to revise Assembly Bill 600 (as introduced) of the Eighty-Third Session of the Nevada Legislature to remove certain provisions previously determined to be violative of the separation of powers doctrine; the Legislature shall also consider legislation to address matters related to cybersecurity, the creation of a general assistance program, school zone traffic safety, the privacy of certain information for public officers, wages and hours, and consider certain appropriations. A summary of those matters is as follows:

Senate Bill 194 (1st Reprint)

AN ACT relating to motor vehicles; requiring a short-term lessor to require proof of certain insurance as a condition for the lease of a passenger car; and providing other matters properly relating thereto.

Senate Bill 434 (3rd Reprint)

AN ACT relating to health care; creating the Statewide Health Care Access and Recruitment Program Account; providing for certain transfers of money out of the Account; requiring a biennial assessment of the health care needs of this State; establishing the Statewide Health Care Access and Recruitment Grant Program to award grants of money to fund certain projects to address shortages of providers of health care or clinical services or expertise identified by the assessment; requiring a grantee to enter into a funding agreement with the Department of Health and Human Services; providing for certain oversight of projects funded through the Program; authorizing the Department to take certain actions in response to certain changes to a funded project or if a grantee fails to comply with a funding agreement or applicable law; making an appropriation; and providing other matters properly relating thereto.

Senate Bill 457 (2nd Reprint)

AN ACT relating to public safety; revising provisions relating to assault, battery, stalking, pornography involving minors, domestic violence, and driving under the influence of alcohol or a prohibited substance; requiring a compliance hearing after the issuance of certain orders to relinquish firearms; establishing certain unlawful acts related to certain theft offenses involving property damage; revising provisions relating to offenders; establishing provisions related to the creation of corridors and the adjudication and reporting of certain offenses committed within such corridors; making various changes related to juvenile justice; prohibiting the construction of certain findings relating to actions for wrongful conviction; revising provisions relating to the sealing of records and specialty court programs; revising provisions relating to pretrial release; revising provisions relating to opioid use disorder; making appropriations; providing penalties; and providing other matters properly relating thereto.

Assembly Bill 238 (2nd Reprint)

AN ACT relating to economic development; enacting the Nevada Studio Infrastructure Jobs and Workforce Training Act; requiring the Office of Economic Development to enter into a development agreement to establish certain criteria for the development of infrastructure for the production of motion pictures and other qualified productions and other new capital investment in this State; establishing certain penalties if the development does not meet certain requirements for new capital investment and expenditures for the production of motion pictures and other qualified productions; establishing requirements for a production company located at such a development to be eligible for film infrastructure transferable tax credits for qualified productions produced at the development; providing for the calculation of the amount of film infrastructure transferable tax credits; requiring the creation of a production studio entertainment district; revising provisions governing noninfrastructure transferable tax credits for motion pictures and other qualified productions produced in this State; authorizing an additional amount of noninfrastructure transferable tax credits; establishing the Account for Nevada Film, Media and Related Technology Education and Vocational Training and a board to approve distributions from the Account; providing for the distribution of money from the Account to certain entities and organizations that provide education and vocational training to develop a workforce for the production of qualified productions in this State; and providing other matters properly relating thereto.

Assembly Bill 404 (2nd Reprint)

AN ACT relating to alcoholic beverages; authorizing a person who operates a brew pub to engage in certain activities concerning the sale of alcoholic beverages; revising provisions governing the conduct of certain investigations and hearings and the revocation and suspension of certain licenses relating to intoxicating liquor; revising the manner in which a payment from a retail liquor store to a wholesale dealer for delivery of certain alcoholic beverages must be made; requiring certain persons manufacturing liquor to preserve certain records for inspection and audit by the Department of Taxation; and providing other matters properly relating thereto.

Senate Bill 450 (1st Reprint), 82nd Legislature

AN ACT relating to housing; establishing a program for the relocation of persons residing in single-family residences in the Windsor Park neighborhood of the City of North Las Vegas; making appropriations; requiring quarterly reports to the Interim Finance Committee; and providing other matters properly relating thereto.

Assembly Bill 600 (as introduced), 83rd Legislature

AN ACT relating to the Legislative Department; clarifying that proceeds of sales of certain items approved by the Director of the Legislative Counsel Bureau must be deposited in the Legislative Fund; clarifying that the organization of the Nevada Revised Statutes into titles by the Legislative Counsel does not constitute a legislative determination for certain constitutional purposes; placing a certain parcel of land under the exclusive supervision and control of the Legislature, contingent upon its purchase; and providing other matters properly relating thereto.

The Legislature shall also consider legislation to revise Chapter 242 and other appropriate chapters of Nevada Revised Statutes governing cybersecurity and related matters to create and establish the duties of the Security Operations Center within the Office of the Chief Information Officer within the Office of the Governor, to create the Account for the Security Operations Center and prescribing the use of money in the Account, to require the Security Operations Center to prepare an annual report that assesses the effectiveness of the Security Operations Center, to establish the Cybersecurity Talent Pipeline Program, to revise the purpose of the Office of the Chief Information Officer, to authorize the board of trustees of a school district to use the services and equipment of the Office, to make various other changes relating to the cybersecurity of governmental entities, to make appropriations, and to provide for other matters properly relating thereto.

The Legislature shall also consider legislation to revise Chapter 422A and other appropriate chapters of Nevada Revised Statutes governing supportive services and related matters to create and establish the duties of the Silver State General Assistance Program within the Division of Welfare and Supportive Services, to provide for the funding of the Silver State General Assistance Program, to describe the powers and duties of the Administrator of the Silver State General Assistance Program, and to provide for other matters properly relating thereto.

The Legislature shall also consider legislation to revise Chapter 484B and other appropriate chapters of Nevada Revised Statutes governing the Rules of the Road to increase local discretion over school zone design and increase penalties for traffic violations in school zones.

The Legislature shall also consider legislation to revise Chapter 293 and other appropriate chapters of Nevada Revised Statutes governing elections and certain private information to make certain revisions related to campaign expenses for personal security, and to add “public officers” to the list of people authorized to request that certain personal information be kept confidential.

The Legislature shall also consider legislation to revise Chapter 608 of Nevada Revised Statutes governing compensation, wages, and hours to conform with sections 7 and 13 of 52 Stat. 1060, 29 U.S.C.A. 207, 213 as amended, and sections 2 and 4 of 29 U.S.C. 252 and 254.

The Legislature shall also consider appropriations to provide for the following:

  1. For the costs of stipends for public defenders, rural judges, and certain district attorneys and other costs of the Department of Indigent Defense Services related to compliance with the Davis Stipulated Consent Judgment;
  2. For the provision of a jail-based behavioral health program consistent with Section 3.5 of Senate Bill 281 of the Eighty-Third Session of the Nevada Legislature;
  3. To replenish the IFC Contingency Account for the provision of three Wildland Fire Trucks for the Nevada Division of Forestry;
  4. Continued funding for certain positions in the Office of Nevada Boards, Commissions, and Councils Standards within the Department of Business and Industry;
  5. To replenish the Disaster Relief Account and the IFC Contingency Account;
  6. For analytical technology software to review SNAP caseload each month to identify cases most likely to contain errors allowing DSS staff to focus on these cases to improve accuracy with a targeted approach to aid in reducing Nevada's SNAP error rate;
  7. To address a projected shortfall from the budget reconciliation act’s change in administrative cost sharing for SNAP;
  8. For costs associated with the Commission on Innovation and Excellence in Education;
  9. For the costs of equipment for the State Medical Lab located at the University of Nevada, Reno;
  10. For the provision of portable medical care stations for use by the Department of Corrections;
  11. For the purpose of compensating brokers to enroll individuals in plans authorized under Chapter 695k of Nevada Revised Statutes;
  12. To the Nevada Health Authority to carry out a program to award grants to certain community-based organizations to provide education and enrollment assistance related to Nevada Medicaid;
  13. For general obligation bonds to be used for the expeditious construction of the University of Nevada, Reno’s Life Sciences Building; and
  14. For an adjustment to the maximum salary for the State Chief Information Officer.

The Special Session shall begin at 10:00 a.m. on November 13, 2025.

The Legislature may also consider an appropriation to pay for the cost of the special session.
