DECLARATION OF EMERGENCY - AMENDMENT
Amendment to Proclamation Declaring a Severe Weather Emergency
WHEREAS, on March 10, 2023, a Declaration of Emergency was issued pursuant to Nevada Revised Statute 414.070 in response to the effects of the severe weather system than began on March 9, 2023; and
WHEREAS, on March 11, 2023, the Declaration of Emergency was amended to include additional jurisdictions; and
WHEREAS, the State of Nevada experienced significant damage from a series of extreme weather events, which caused flooding that began on March 9, 2023, and continues to impact the State of Nevada; and
WHEREAS, the impacts of these severe weather events continue to evolve, and additional counties and tribal nations have declared a state of emergency; and
WHEREAS, the counties of Churchill, Douglas, Eureka, Lincoln, Lyon, and Storey, as well as the Walker River Paiute Tribe, Yerington Paiute Tribe, and Yomba Shoshone Tribe have declared a state of emergency; and
WHEREAS, other areas of Nevada are also experiencing the effects of the severe weather systems including the counties of Elko, Humboldt, Mineral, Nye, and Washoe; and,
WHEREAS, multiple interstate, intrastate, and local roads have been damaged from flood, avalanches, and rockslides; and
WHEREAS, the State of Nevada will require assistance from the Federal Highway Administration on eligible roads and projects which will be identified when damage assessment is completed; and
WHEREAS, the State of Nevada's critical infrastructure has been pushed to its capacity, creating concern related to dam integrity in Lincoln County, and the resultant impacts on downstream communities and threat to life and safety.
Now therefore, I, Joe Lombardo, Governor of the State of Nevada, pursuant to the authority vested in me by the Constitution and laws of the State of Nevada, hereby amend the state of emergency issued on March 10, 2023 (and amended on March 11, 2023), to include the following direction:
- The Nevada Department of Transportation shall formally request immediate assistance through the Federal Highway Administration's Emergency Relief Program, United States Code, Title 23, section 125, in order to obtain federal assistance for highway repairs or reconstruction.
- I hereby delegate to Lincoln County, Board of County Commissioners, the authority to compel evacuation of the population from any stricken or threatened area within the County, should it determined that it is necessary or prudent to protect the health and safety of persons in this state. Additionally, I hereby authorize Lincoln County, Board of County Commissioners, to subdelegate that authority to any county official, department, or agency that is deemed proper.
