DECLARATION OF EMERGENCY
Proclamation Declaring a Liquid Petroleum Gas Delivery Emergency
WHEREAS, Nevada Revised Statute 414.070 authorizes the Governor to issue a proclamation declaring a state of emergency when a natural disaster of major proportions has occurred within the State, and the invocation of the Governor's emergency powers is necessary to protect the health and safety of persons in the State; and
WHEREAS, the people and businesses of the State of Nevada depend on adequate propane supplies, especially during winter months, to, among other things, heat homes and power essential government and business equipment; and
WHEREAS, a series of storms and unsettled weather conditions have compounded existing propane supply chain problems and are anticipated to continue impacting parts of the State of Nevada in the coming weeks; and
WHEREAS, these extreme weather conditions have slowed down the delivery of propane because it requires drivers delivering propane to travel distances greater than usual; and
WHEREAS, the slowdown in propane delivery has caused a drop in propane supply; and
WHEREAS, pursuant to 49 C.F.R. § 390.23 certain motor carrier safety regulations (e.g. limiting the hours that drivers may drive each day) may be suspended in response to a declared emergency by the Governor; and
NOW, THEREFORE, I, Joe Lombardo, Governor of the State of Nevada, pursuant to the authority vested in me by the Constitution and laws of the State of Nevada and the United States and to facilitate the suspension of the hours of service requirements contained in 49 C.F.R. § 395.3 of the Federal Motor Carrier Safety Regulations hereby declare a limited State of Emergency arising from the extreme winter conditions that have decreased the supply of propane. The Director of the Nevada of Department of Public Safety and local government officials are directed to take all appropriate action to comply with the intent of the declaration.
Unless renewed, this limited declaration shall expire in fifteen (15) days.
