EXECUTIVE ORDER 2025-003

Providing for the Immediate Organization of the Nevada Education Service Center

WHEREAS, improving the academic achievement of students is of utmost importance to the future of this state; and

WHEREAS, since 2023, the State of Nevada has made historic investments in public education—including $2.6 billion in new K–12 funding, expanded early literacy and pre-K programs, increased school choice, improved teacher compensation, and accountability reforms—ensuring all Nevada students have access to a high-quality education regardless of background or income; and

WHEREAS, despite historic education investments, continuing challenges in student achievement, financial oversight, and district governance, highlight the need for continued, ongoing reform; and

WHEREAS, Senate Bill 460 of the 83rd Legislative Session (“SB 460”) seeks to strengthen accountability, and ensure governance focused on student outcomes, fiscal integrity, and access to opportunity; and

WHEREAS, SB 460, codified as Statutes of Nevada 2025, Chapter 506, creates an Education Service Center; and

WHEREAS, the new Education Service Center must provide essential services to school districts and charter school sponsors in advance of new accountability measures; and

WHEREAS, SB 460, in creating the Education Service Center, left unclear certain details related to the timeline for the immediate implementation and operationalization of the same; and

WHEREAS, it is in the best interest of the State of Nevada that the new Education Service Center begin immediately to meet the needs of school districts and charter school sponsors in a manner which is both nimble and rigorous; and

WHEREAS, Article 5, Section 1 of the Nevada Constitution provides that, “[t]he Supreme Executive Power of this State shall be vested in a Chief Magistrate who shall be Governor of the State of Nevada.”

NOW, THEREFORE, by the authority vested in me as Governor by the Constitution and laws of the State of Nevada and the United States, it is hereby ordered as follows:

SECTION 1:

As soon as practicable the State Superintendent shall issue emergency regulations prescribing the operating procedures for the new Education Service Center (the Center). Consistent with those emergency regulations, to enable the efficient implementation of the Center, I also order the following:

SECTION 2:

The Nevada Department of Education shall function as the fiscal agent and administrative host of the Center. As fiscal agent, the Department is responsible for the payment, collection and holding of all money received from this State for the maintenance and support of the Center.

SECTION 3:

Pursuant to this order, a qualified person shall be identified to serve by my appointment as the Center’s Interim Executive Director, to begin service on October 27, 2025. Nothing in this section shall be construed to interfere with the power of the Center’s governing board ultimately to hire the Executive Director, whether by retaining the Interim Executive Director or conducting a search for a new Executive Director during the Interim Executive Director’s service.

SECTION 4:

Consistent with NRS 223.085(1)(e), employees of the Center are hereby deemed necessary to effectively fulfill the duties, responsibilities, and obligations of the Office of the Governor. Therefore, the Executive Director of the Center, and any state employees hired by the Center, are not in the classified or unclassified service of the State and serve at the pleasure of the Governor.

SECTION 5:

The State Superintendent and Interim Executive Director shall enter into a memorandum of understanding providing such services as the State Superintendent deems necessary and providing sufficient funding consistent with available legislative appropriations approved in SB 460 and any other eligible source of funding to carry out the memorandum of understanding and provide adequate resources for the operation of the Center, including but not limited to its staff and independent contractors.

This order is effective upon signature and shall remain in force until June 30, 2027, unless amended, modified, terminated, or rescinded by the Governor.
