EXECUTIVE ORDER 2023-001

Order Rescinding All COVID-19 Era Declarations, Executive Orders and Emergency Directives

WHEREAS, on or about March 12, 2020, then Governor Sisolak issued a Declaration of Emergency in response to the COVID-19 pandemic; and

WHEREAS, throughout the COVID-19 pandemic, then Governor Sisolak issued a series of Executive Orders and Emergency Directives in the years 2020, 2021 and 2022; and

WHEREAS, our understanding of the COVID-19 virus and our ability to avoid, diagnose and treat illnesses resulting from COVID-19 have evolved to substantially reduce the risk that gave rise to the March 12, 2020 Declaration of Emergency and to subsequent, related Emergency Directives and Executive Orders; and

WHEREAS, it is in the best interest of the State of Nevada that the people of this State and businesses operating in this State are unencumbered by any restrictions, limitations or requirements put in place in response to COVID-19; and

WHEREAS, then Governor Sisolak through a Proclamation dated May 18, 2022, terminated the first Declaration of Emergency related to COVID-19 (March 12, 2020 Declaration) but left unclear and uncertain the status of subsequent declarations, proclamations, directives and orders; and

WHEREAS, Article 5, Section 1 of the Nevada Constitution provides: “The supreme executive power of this State, shall be vested in a Chief Magistrate who shall be Governor of the State of Nevada.”

NOW, THEREFORE by the authority vested in me as Governor by the Constitution and laws of the State of Nevada and the United States, it is hereby ordered as follows:

SECTION 1:

To the extent that any COVID-19 Emergency Directives and Executive Orders have not been repealed or rescinded, in full or in part, they are hereby rescinded to include the following: 

  1. Declaration of Emergency (March 12, 2020);

SECTION 2:

Notwithstanding Section 1, nothing in this Executive Order shall repeal or alter any COVID-19 provisions that would affect any federal funding sources.
