EXECUTIVE ORDER 2022-15

ORDER REGARDING FLYING FLAGS AT HALF-STAFF

WHEREAS, federal law, 4 U.S.C. Chapter 1 (§$ 1-10), governs the proper display of the United States flag, including the circumstances when the national flag may be flown at half-staff, and

WHEREAS, federal low, 4 U.S.C. § 7(m), provides that the United States flag shall be flown at half-staff for certain prescribed periods following the death of certain officials and that the President of the United States may order the United States flag to be flown at half-staff in other circumstances, not inconsistent with law. That statute further provides for the circumstances when the Governor may order the United States flag to be flown at half-staff; and

WHEREAS, in addition to the times for flying the United States flag at half-staff that are prescribed in statute, the President periodically orders the United States flag to be flown at half-station federal buildings, installations, facilities, and vessels to mark certain occasions or to honor a person; and

WHEREAS, the Governor traditionally orders both the United States flag and the State of Nevada flag to be flown at half-staff on all state-owned buildings, installations, and facilities, in conjunction with an order issued bv the President; and

WHEREAS, Article S Section 1 of the Nevada Constitution Provides: “The supreme executive power of this State, shall be vested in a Chief Magistrate who shall be Governor of the State of Nevada.”

NOW, THEREFORE, Article S Section 1 of the Nevada Constitution Provides: “The supreme executive power of this State, shall be vested in a Chief Magistrate who shall be Governor of the State of Nevada.”

Whensoever the President of the United States shall order, or federal law shall require, that the flag of the United States be flown at half-staff on all federal buildings, grounds, and facilities, the flag of the United States and the flag of the State of Nevada shall be flown at half-staff at the State Capitol and all State public buildings and grounds for the same duration as specified in the President’s order or federal law, as the case may be.
