Public Record Requests

Public Records Request Policy:

Requests to the Governor's Office, must be made in writing on the form below.

Nevada regulations (NAC 239.863) provide for the form below to be completed when submitting requests to inspect, copy or receive a copy of public records. Written requests allow staff to more effectively track and monitor a request.

Written requests may be sent by US Mail or email to the designated public records officer, or to the Governor’s Office, Attn: Office of the General Counsel, or to GovPublicRecords@gov.nv.gov.

According to NRS 239.0107, government entities will respond to requests for inspection or copying of public books or records, with these actions:

Not later than the end of the fifth business day after the date on which the person who has legal custody or control of a public book or record of a governmental entity receives a request from a person to inspect or copy the public book or record, a governmental entity shall do one of the following, as applicable:

  1. Allow the person to inspect a copy of the public book or record. If the request is to receive a copy, provide copies to the requester. If the public book or record is not readily available, see "c" below.

  2. If the Governor's Office does not have the legal custody or control of the public book or record, provide to the person in writing:

    • Notice of the fact; and
    • The name and address of the governmental entity that has legal custody or control of the public book or record, if known:
     
  3. Except as otherwise provided in paragraph (d), if the Governor's Office is unable to make the public book or record available by the end of the fifth business day after the date on which the person who has legal custody or control of the public book or record received the request, provide to the person in writing:

    • Notice of that fact; and
    • A date and time after which the public book or record will be available for the person to inspect or copy. If the public book or record is not available to the person to inspect or copy by that date and time, the person may inquire regarding the status of the request.
     
  4. If the Governor's Office must deny the person's request to inspect or copy the public book or record because the public book or record, or a part thereof, is confidential, provide the person, in writing:

    • Notice of that fact; and
    • A citation to the specific statue or other legal authority that makes the public book or record, or a part thereof confidential.

Documents on Website

The person requesting the information may be directed to the Governor’s Office website (gov.nv.gov), and subsequent State of Nevada websites, where many documents are posted online.

Personnel Time:

As permitted, personnel time is an allowable charge for extraordinary requests. Personnel time to review, redact, copy, process, or otherwise provide access to public records; will be charged at a rate of $20 per hour.

Copying Fees:

  1. Black and white copies, up to 8.5" x 11". $.05/per page
  2. Color, up to 8.5" x 11". $.50/per page
  3. Compact Disc/DVD/Thumb Drive: $5/per device
  4. Postage:

The requester is responsible for estimated postage.

Payment:

Payments must be made before work on the records request commences. Payment must be made by check to the "State of Nevada Governor's Office".

Process to Receive or Review Information

The Governor's Office will notify the requester in writing within 5 business days of when the records for inspection or copies will be available. If requests are made which may require an extraordinary amount of staff time to fulfill, the response will indicate when further notification will be made as to the availability of the public record and provide a fee assessment if applicable.

Inspection of such public books or records must take place in the Governor's Office during normal business hours, Monday through Friday, 8:00 to 5:00. Governor's Office staff will observe the inspection of the record to ensure the records are not removed, disassembled or altered. Access to public records may be made in installments if the person who requested to inspect the record agrees and the record is large enough that it would be reasonably practicable to provide access to the record in installments.

If the requester asks for copies of specific documents while on site, copies will be made by Governor's office staff, when staff is available. If records contain confidential information, staff will provide a redacted version of the requested document. Because it will take time for staff to prepare documents that need redacting, it is best to make arrangements ahead of time to give staff ample time to prepare documents.

When requested copies of a public book or record are completed, the Governor's Office will notify the requester that the information may be picked up at the office, or be sent via regular mail. Information will be held for a maximum of 30 days.

To enable the Governor's Office to respond accurately and completely to requests, requests should be made in writing using the request form. Requests for public information documents can be made via regular mail or email. All such requests for Governor's office public record documents may be sent to the designated agency public records officer:
