State of Nevada Executive Order - Executive Department


Whereas, between the dates of August 15, 2018, and August 16, 2018, Clark County experienced a severe weather system that produced heavy rainfall;
Whereas, the heavy rainfall caused severe flooding and extensive damage to State Route 164, State Route 156 and State Route 158, in Clark County;
Whereas, State Route 164 sustained approximately four (4) miles of road damage between milepost 2.0 and milepost 6.0, resulting in the closure of State Route 164, State Route 156 sustained over three (3) miles of road damage between milepost 0.0 and milepost 3.3 resulting in the closure of State Route 156, and State Route 158 sustained nearly nine (9) miles of road damage between milepost 0.0 and milepost 8.8;
Whereas, the condition of the damaged transportation routes in Clark County constitute an emergency, as contemplated by Section 120(e) and Section 125 of Title 23 of the United States Code;
Whereas, Nevada Revised Statute 414.070 authorizes the Governor to issue a proclamation declaring a state of emergency when a natural, technological or man-made emergency or disaster of major proportions has occurred within the State of Nevada, and the assistance of State agencies is needed to supplement the efforts and capabilities of political subdivisions to save lives and protect the health, safety, and welfare of persons and property;
Whereas, I, as Governor, on August 17, 2018, authorize and direct that the State of Nevada mobilize and make available all State resources necessary to respond to this matter;
Whereas, Article 5, Section 1 of the Nevada Constitution provides: “The supreme executive power of this State, shall be vested in a Chief Magistrate who shall be Governor of the State of Nevada.”

Now, Therefore, by the authority vested in me as the Governor by the Constitution and laws of the State of Nevada, hereby declare and proclaim that a state of emergency for Clark County exists due to the heavy rainfall, subsequent road damage, and resulting danger to life and property that occurred between August 15, 2018, and August 16, 2018, and that the immediate repair and reconstruction of the damaged highway is vital to the security, well-being, and health of the citizens of this State.
