Declaration of Emergency
for Esmeralda County Due To Flooding

Whereas, on October 26, 2015, I, as the Governor of the State of Nevada, issued a proclamation declaring a state of emergency due to the effects of a severe weather system that produced heavy rainfall in Nye County on October 18, 2015, and directed all agencies of the State to assist and supplement the efforts of Nye County to protect the health, safety and welfare of persons and property;
Whereas, additional damage from the October 18, 2015, flooding event has been discovered that extends into Esmeralda County;
Whereas, transportation routes in Esmeralda County, including Highway 267, which is a federal aid highway, sustained significant road damage that requires repair and reconstruction;
Whereas, the condition of damaged transportation routes in Esmeralda County constitute an emergency, as contemplated by Section 120(e) and Section 125 of Title 23 of the United States Code;
Whereas, Esmeralda County requires assistance from the State of Nevada to protect the health, safety, and welfare of persons and property;
Whereas, Nevada Revised Statute 414.070 authorizes the Governor to issue a proclamation declaring a state of emergency when a natural, technological or man-made emergency or disaster of major proportions has occurred within the State of Nevada, and the assistance of agencies of the State is needed to supplement the efforts and capabilities of political subdivisions to save lives and protect the health, safety, and welfare of persons and property; and
Whereas, Article 5, Section 1 of the Nevada Constitution provides: "The supreme executive
power of this State, shall be vested in a Chief Magistrate who shall be Governor of the State of Nevada."

Now, Therefore, by the authority vested in me as the Governor by the Constitution and laws of the State of Nevada, hereby declare and proclaim that a state of emergency for Esmeralda County exists due to the flooding and subsequent danger to life and property that occurred on October 18, 2015, and that the immediate repair and reconstruction of the damaged highways and roadways is vital to the security, well-being, and health of the citizens of this State.
